Conditions and Terms under which services are renderd and tools & equipment are rented

TOOL RENTAL CHARGES AND SUPERVISOR

1. Scheduled rental rates begin when tools leave Cagle Fishing & Rental Tools, LTD. service point, and the customers responsibility hereunder continues until they are returned thereto. Twenty-four (24) hours or any part thereof constitutes the first day rental; additional days begin at midnight and con­tinue until the tools are returned. Tools or equipment obtained from outside sources are subject to the prevailing conditions, warranties if any, and prices established by the supplier. Tools left on location on a standby-basis will be charged as follows: Whether used or not, a first day or minimum rental will be charged for each tool for each month or part thereof, plus regular rental rates will be charged for each day the tool or tools are actually used. Overshots for stand-by rental will be furnished with three (3) grapples and controls only, other parts will be charged at fifty ($50.00) dollars each stand-by rental, unless damaged beyond repair, which will constitute a sale at current retail rates. DAMAGED OR LOST TOOLS: Damaged tools will be repaired at the expense of the renter. Tools damaged beyond repair or lost will be charged to the renter at current retail prices. No depreciation or rent shall be deducted from purchase price. Tools and parts charged as damaged beyond repair will be held for sixty (60) days and disposed of at that time unless claimed. Rental charged plus sale price of tool or parts will be applicable as charges.
SPECIAL TOOLS ordered and built will be charged for on the basis of the applicable shop time, plus a minimum rental, whether or not the tool is used.

SUPERVISORS:

Consulting supervisors time will be charged at fourteen-hundred ($1,400.00) dollars per day for each supervisor required on the job. Fishing tool supervisor's time will be charged at fourteen-hundred ($1,400.00) dollars per day for twenty-four (24) hours. Supervisor's first day will begin at the time he leaves the Cagle service point. The first day ends at midnight and may consist of twenty-four (24) hours or any part thereof. Additional days begin and end at midnight and continue until the supervisor is released by authorized person or persons. Supervisor's time for daylight fishing shall be charged at one thousand fifty ($1,050.00) dollars per twelve (12) hours or any part thereof. Reverse Unit Supervisor's time for daylight operations shall be charged at eight-hundred fifty ($850.00) dollars per twelve (12) hours or any part thereof. Supervisor's mileage will be charged at one dollar and seventy-five cents ($1.75) per round trip mile. A minimum of one hundred ($100.00) dollars will be charged for round trips of fifty miles or less.

HOTSHOT FREIGHT AND HAULING CHARGES:

Hotshot freight and hauling charges via company car or pickup will be charged at one dollar and seventy-five cents ($1.75) per mile, round trip mileage. Trucking with company pickup and tool trailer will be charged at one dollar and seventy-five cents ($1.75) per mile, round trip mileage. A minimum of one hundred ($100.00) dollars will be charged for round trips of fifty miles or less. Trucking with company winch-truck and float will be charged at ninety-five ($95.00) dollars per hour. Charges begin upon loading of equipment and or tools, and stop when equipment and tools are unloaded. A minimum of two hundred fifty ($250.00) dollars will be charged for round trips of fifty miles or less. Charges by common carrier will be billed on the same basis as Cagle has been charged. It is expressly understood that the customer will make arrangements for transportation of our men and equipment into and out of inaccessible locations, and is to pay all expenses incurred.
4. TAXES: All Federal, State and Municipal taxes now or hereafter imposed with respect to services rendered or rental of equipment and/or processing, manufacturing, safe, delivery, transportation and/or proceeds of the merchandise or equipment rented or sold herein specified shall be for the account of the buyer, and if paid or required by the seller the amount thereof shall be added to and become a part of the price payable by the buyer/ renter.
